NightCoders Terms & Conditions

By using NightCoders services, joining our community programs, or purchasing a product package, you agree to these terms.

If you are engaging NightCoders on behalf of a company or team, you confirm that you have authority to bind that organization to this agreement.

• Product design and engineering engagements, from discovery through launch.
• Retainer and continuous product iteration programs.
• Community initiatives such as NightCoders Meet, workshops, and mentoring sessions.

• Share accurate and up-to-date information when submitting briefs or onboarding.
• Respect NDAs, privacy guidelines, and the confidentiality of other members' projects.
• Avoid using our platforms for illegal activities, spam, or any behaviour that infringes on third-party rights.

Pricing, milestones, and billing schedules will be outlined in a proposal or statement of work for each engagement.

• Retainer fees are invoiced upfront before a sprint or cycle begins.
• If an engagement is cancelled mid-sprint, we may charge for work already delivered or committed resources.
• Refunds are only issued if NightCoders materially breaches the agreed scope or deliverables.

Unless otherwise agreed in writing, clients receive ownership of final deliverables after all invoices are paid.

NightCoders may reference a project in case studies or portfolios with explicit permission from the client.

NightCoders is not liable for indirect, incidental, or consequential damages arising from use of our services.

Our total liability under this agreement will not exceed the fees paid by you to NightCoders during the previous three (3) months.

We may update these terms from time to time. Continued use of NightCoders services after changes take effect constitutes acceptance of the revised terms.
